Bench Warrants

When a person fails to appear in court or pay court fee, a bench warrant will be issued in his/her name. A bench warrant is a court-issued document that gives law enforcement officials the right to arrest and detain the person whose name appears on the document.  Bench warrants are issued to guarantee that people will appear in court to take care of their pending legal action.  At McDonald & Campbell, we have represented clients throughout Orange County with bench warrants issued in their name for the following reasons:

  • Failure to appear in court
  • Failure to pay a court fee
  • Failure to pay a fine
  • Failure to comply with court orders
  • Failure to appear in court after being released from custody
  • Failure to show proof of progress or completion of a court order

As soon as the court issues and approves a bench warrant it becomes effective immediately. Once the bench warrant has been issued, law enforcement officials have the right to arrest and detain the individual whose name appears on the warrant as soon as he/she is found. Once the person as been arrested, he/she is required to wait in jail until bail can be posted.
