Frequently Asked Questions

1. What is a misdemeanor?
Misdemeanor crimes are considered less serious criminal offenses, and are typically punishable by no more than one year in county jail, fines not exceeding $1000, probation, community service, rehabilitation, and driver’s license suspension. Common types of misdemeanor crimes include petty theft, traffic violations, simple assault, minor drug charges, and domestic violence.

2. What is a felony?
Felonies are highly serious criminal offenses that are punishable by incarceration in a state prison, steep fines, probation, counseling/rehabilitation, restitution, mandatory registration as an offender, and even the death penalty in same cases. Common types of felony crimes include murder, homicide, sex crimes, aggravated assault, terrorist threats, grand theft, armed robbery, embezzlement, espionage, major drug crimes, and most white collar crimes.

3.  Will I go to jail?
It depends on the circumstances surrounding your arrest and the severity of the crime. Most felony crimes are punishable by incarceration. Misdemeanor crimes are typically not publishable by serving time in jail.  If you are charged with a felony crime, an experienced attorney can negotiate with prosecutors and judges to get your charges dropped or reduced to a lesser offense.

4. What should I say to police if they ask me questions?
If the police try to ask you questions about the crime, it’s important to refrain from making any statements.  Anything you say to the police can and will be used as evidence against you in court. The best thing to do is simply say, “I would like to speak with an attorney before I answer any questions.”

5. Why should I hire an attorney?
If you are charged with a criminal offense, having an experienced attorney on your side is your greatest asset. An attorney can help you file important court documents, and guide you through every step of the legal process. In addition, a good attorney will provide you with multiple options, extensive resources, and sound advice so you can make educated decisions. Furthermore, a skilled attorney will protect your rights, fight on your behalf, and negotiate with aggressive prosecutors looking to put you in jail.  An experienced attorney will also try to get your charges reduced or dismissed, and work to help you avoid harsh legal penalties.
